Tài phán hành chính – cơ chế kiểm soát quyền lực nhà nước của tư pháp đối với hành pháp

Tóm tắt: Kiểm soát quyền lực nhà nước (QLNN) giữa các nhánh quyền lực là một nội dung quan trọng trong xây dựng nhà nước pháp quyền. Bài viết phân tích những cơ sở để khẳng định tài phán hành chính (TPHC) là một cơ chế kiểm soát QLNN của tư pháp đối với hành pháp; đồng thời nêu những bất cập trong cơ chế kiểm soát này và đề xuất một số giải pháp nhằm nâng cao hiệu lực, hiệu quả kiểm soát quyền lực của tư pháp đối với hành pháp thông qua TPHC.

Abstract: Supervision of state administration power (SSP) among the powerful state branches is an important role for development of the rule of law. This article provides analysis of the asserted basis for administrative tribunals (AT) – a supervisory mechanism for state administration power of judicial enforcement; it also gives out the shortcomings in this supervisory mechanism and proposes solutions to improve the effectiveness and efficiency supervision of the judicial power to the executive through the administrative tribunals.
