Quyền dân sự liên quan đến tài liệu của cá nhân, gia đình, dòng họ và những vấn đề pháp lý cần được quan tâm trong xây dựng, hoàn thiện Luật Lưu trữ

Tóm tắt: Trong bài viết này, tác giả phân tích làm rõ bản chất pháp lý của tài liệu cá nhân, việc xác lập mối quan hệ pháp lý dựa trên nền tảng pháp luật dân sự giữa cá nhân có tài liệu với cơ quan, tổ chức lưu trữ và giữa một trong hai chủ thể này với chủ thể khác có quyền, lợi ích liên quan trong quá trình thực hiện các hoạt động lưu trữ (sưu tầm, chỉnh lý, bảo quản và sử dụng) tài liệu của cá nhân; kiến nghị hoàn thiện các quy định của pháp luật điều chỉnh quan hệ xã hội đối với tài liệu lưu trữ tư.

Abstract: Under this article, the author provides an analysis and clarifications of the legal nature of personal documents, establishment of legal relationship on the ground of the civil law between the individuals of the archived documents and the entity or organization who stores the documents and between one of these two subjects and another with related rights and interests in the process of performing the archival activities (collection, correction, preservation and reference) of the personal documents; and gives out recommendations for improvements of the provisions of the law governing social relations for private archived documents.
